REGULATIONS OF DIGNITO INTERNET SHOP

I. Definitions

The terms used in the Regulations shall have the following meaning:

1. Customer – a natural person, legal person or an organisational entity without legal personality with legal capacity subject to applicable regulations, who place Orders in the Shop;

2. Civil Code - Act of 23 April 1964 (Journal of Laws of 1964, No. 16, item 93, as amended);

3. Regulations – these Regulations of the provision of electronic services in Dignito internet shop;  

4. Internet Shop (Shop) – internet service available at www.dignito.pl via which Customers may in particular place Orders;  

5. Goods – products presented in the Internet Shop;

6. Sales contract – sales contract for Goods within the meaning of the Civil Code, concluded between Dignito Michael Karlak and the Customer, executed over the service of the internet Shop;

7. Act on specific conditions of sales to consumers – Act of 27 July 2002 on specific conditions of sales to consumers and amending the Civil Code (Journal of Laws No. 141, item 1176, as amended) ;

8. Act on electronic services – Act of 18 July 2002 on electronic services (Journal of Laws No. 144, item 1204, as amended) ;

9. Order – Customer’s declaration of intent with a direct intention to conclude a Sales contract specifying in particular the type and quantity of Goods.

10. Service – activities takes in order to satisfy Customers’ specific need or needs and carried out with their involvement, often for commercial purposes.  Services in economic sense in a useful intangible process generated by human labour in a production process by affecting the structure of certain objects.

11. Dignito Michael Karlak – Entity operating the internet Shop.

 

II. General provisions

2.1. These Regulations set forth the rules of using the internet shop available at www.dignito.pl.

2.2. These Regulations are regulations referred to in Art. 8 of the Act on electronic services.

2.3. The internet Shop operating under www.dignito.pl is operated by Dignito Michael Karlak.

2.4. These Regulations set forth in particular:

a.) the rules of registration and using the account in the internet shop;

b.) the conditions and rules of making electronic reservation of products available in the internet shop;

c.) the conditions and rules of placing electronic Orders with the internet shop;

d.) the rules of concluding Sales contract with the services provided in the internet Shop.

2.5. In order to use the internet Shop, the Customer should use a computer or an end device with access to the Internet.

2.6. In compliance with the applicable legal regulations, Dignito Michael Karlak reserves the right to restrict its provision of services via the internet Shop to persons who are minimum 18 years of age. In such situation, Customers shall be notified thereof.

2.7. Customers may access these Regulations at any time via the link provided on the main page of www.dignito.pl and download the text and have it printed.

2.8. Information on the Goods published on the internet pages of the Shop, in particular their descriptions, technical and application parameters as well as the prices, constitute an invitation to conclude a contract within the meaning of Art. 71 of the Civil Code.

 

III.  Principles of using the Internet Shop  

3.1. The internet Shop may be used subject to prior registration with the Shop.

3.2. Registration is accomplished by completing and accepting the registration form accessible at a page of the Shop.

3.3. Registration shall be subject to accepting the content of the Regulations and provision of personal data in the fields marked as mandatory.

3.4. A Shop employee may block the Customer's right to use the Internet Shop or restrict access to resources of the Internet Shop in whole or in part with immediate effect if the Customer breaches the Regulations, in particular when the Customer:

a.) at registration with the Internet Shop provided untrue, incomplete or obsolete data, misleading data or infringing upon third party rights,

b.) using the Internet Shop violated personal third party rights, in particular personal rights of other customers of the Internet Shop,

c.) acts otherwise that will be recognised by employees of the Internet Shop as incompliant with law or general rules of using the Internet or infringing the reputation of Dignito Michael Karlak

3.5. The person who has been deprived of the right to use the Internet Shop may not re-register without prior approval by a Shop employee.

3.6. In order to ensure the safety of transmission of messages and data related to the services provide over the website, the Internet Shop applies technical and organisational measures adequate to the hazards to the provided services, in particular measures preventing interception and modifications by unauthorised persons of personal data by transmitted over the Internet.

3.6. The Contractor is obliged in particular:

a.) not to submit and not to transmit content that is prohibited by law, e.g. content propagating violence, defaming or violating personal and other rights of third parties,

b.) to use the Internet Shop in a manner not interfering with its functioning, in particular by using certain software or devices,

c.) not to take such actions as: sending or placing spam in the Internet Shop,

d.) use the Internet Shop in a manner not onerous for other customers and for Dignito Michael Karlak,

e.) use all content published in the Internet Shop solely for their own internal use,

f.) use the Internet Shop in compliance with the laws in force in Poland, provisions of the Regulations and general rules of using the Internet.

 

IV. Conclusion procedure of sales contracts

4.1. In order to conclude a Sales contract via the Internet Shop, the Customer shall access the web site www.dignito.pl, select one or more goods and/or services and take other technical actions following the messages displayed to the Customer and information available on the site.

4.2. The ordered Goods/Services are selected by the Customer by adding them to the shopping basket.

4.3. When placing the Order – before the “Order” button is pressed – the Customer may modify the input data and change the selected Goods. To this end, the Customer shall follow the messages displayed and information available on the page.

4.4. When the Customer using the Internet Shop provides all required data, a summary of the placed Order will be displayed. The summary of the placed Order will contain the following information relating to:

a.) object of the order,

b.) unit and total price of the ordered products or services, including delivery costs and additional costs (if any),

c.) selected payment method,

d.) selected delivery method,

e.) delivery time.

4.5. In order to send the Order, it is necessary to accept the text of the Regulations, specify the personal data marked as mandatory and press the button “Place Order”.

4.6. An Order sent by the Customer is a declaration of intent to conclude a Sales contract with Dignito Michael Karlak in accordance with the content of the Regulations.

4.7. When the Order has been placed, the Customer will receive an e-mail message containing a final confirmation of all material elements of the Order.

4.8. The contract shall be deemed as concluded when the Customer received the e-mail message referred to above.

4.9. The sales contract shall be concluded in the Polish language, with its content compliant with the Regulations.

 

V. Delivery  

5.1. Deliveries of Goods are limited to the territory of European Union countries and its effects to the address designated by the Customer at placing the Order.

5.2. The ordered Goods are delivered with personal transport (the Customer personally collecting the Goods), by courtier (UPS), by registered post (Poczta Polska). Subject to the delivery option selected by the Customer, the delivery costs vary – details are provided in the section Delivery costs on the main page of the Internet Shop. Additionally, delivery costs shall be displayed at placing the Order.

5.3. Deliveries shall be made within 3 up to 7 working days from placing the Order by the Customer.

5.4. Customers may access these Regulations at any time via the link provided on the main page of www.dignito.pl and download the text and have it printed.

 

VI. Prices and payment methods  

6.1. The prices of the Goods are provided in EURO and contain all components, including VAT (specifying the VAT RATE), customs duties and all other components.

6.2. The Customer may pay the purchase price in the following manner:

a.) downpayment to the account of:

The payment title shall contain order number and Customer’s first and last name.

b.) payment at delivery:

When payment is made at delivery, the Customer is required to prepare the accurate amount of money.

 

VII. Right to withdraw from the contract

7.1. Customers who are consumers within the meaning of Art. 221 of the Civil Code, are entitled – according to law – to terminate contracts concluded remotely without specifying a reason, by submitting an appropriate written declaration, within 14 days and sending it to the address of Dignito S. C. specified in these Regulations.

7.2. The 14-day period runs from the delivery day of the Goods.

7.3. The right to terminate the contract by consumers shall be excluded in the following instances:

Dignito S. C. commences the provision of the services subject to consumer’s consent;
with respect to goods (services) not offered by the shop as a standard and developed for the customer’s special order and tailored to the customer’s individual needs;
deliveries that due to their nature may not be returned or that are subject to fast deterioration.
7.4. When the contract concluded remotely is terminated, it shall be deemed as not concluded. The mutual benefits of the parties shall be returned unchanged. The return shall be made within maximum 14 days. The purchased goods shall be returned to the following address:

7.5. The Goods returned by the Customer shall be packed in an appropriate manner, ensuring safe transport.

7.6. The costs of packaging and return delivery shall be covered by the Customer.

 

VIII. Complaints relating to Goods

8.1. Dignito Michael Karlak as the seller is liable to the Customers who are consumers within the meaning of Art. 221 of the Civil Code, for compliance with the Sales contract purchased by the consumer to the extent set forth in the Act on specific conditions of sales to consumers.

8.2. Any complaints relating to a breach of Customers’ rights guaranteed by law or pursuant to these Regulations shall be sent to info@dignito.pl. Dignito Michael Karlak shall review each complaint within maximum 5 working days and if this is not possible – to inform the Customer of the period within which the complaint will be reviewed.

8.3. When the goods are delivered, they should be inspected and accept only when the condition raises no doubt. The Customer may report its claims when damaged goods are delivered to the address: info@dignito.pl. Further procedures and activities to be performed will be detailed in a return message sent to the Customer to the designated e-email address.

 

IX. Complaints relating to the provision of electronic services

9.1. Dignito Michael Karlak shall take actions to ensure correct operation of the Shop to the extent resulting from state-of-the-art technical knowledge and shall remedy any irregularities reported by Customers within reasonable time.

9.2. The Customer shall immediately notify Dignito Michael Karlak of any irregularities or interruptions in the functioning of the services of the Internet Shop.

9.3. Irregularities relating to the functioning of the Shop shall be reported by the Customer by e-mail to info@dignito.pl or with the contact form.

9.4. In its complaint the Customer shall specify their first and last name, address for correspondence, type and date of the irregularity related to the functioning of the Shop.

9.5. Dignito S. C. shall review each complaint within maximum 5 working days and if this is not possible – to inform the Customer of the period within which the complaint will be reviewed.

 

X. Final provisions

10.1. Any disputes between Dignito Michael Karlak and the Customer who is a consumer within the meaning of Art. 221 of the Civil Code, shall be referred to courts competent in compliance with the applicable provisions of the Code of civil procedure.

10.2. Any disputes between Dignito Michael Karlak and the Customer that is not a consumer within the meaning of Art. 221 of the Civil Code shall be referred to a court competent for the registered office of Dignito Michael Karlak

10.3. In all matters not provided for in these Regulations, the provisions of the Civil Code, the Act on electronic services and other applicable Polish regulations shall apply.
